Gray Divorce: Navigating Late-Life Separation in Kansas

As our population ages and improvements in healthcare allow many people to remain active well into their retirement years, Americans 50 and above are taking a different approach to divorce than previous generations. While divorces have been down in the general population over the past couple of decades, breakups among spouses in their middle-aged years and older have steadily risen. This phenomenon is often referred to as “gray divorce.”

Many factors have been cited to explain the increase in gray divorce. Individuals in this demographic grew up when societal pressures often kept couples together despite dissatisfaction or unhappiness. Today, much of the stigma has been removed from marriage dissolution. 

Concerns over how a breakup might affect children is something else that stops younger spouses from seeking a divorce even when they are no longer happy in their relationship. Without the shared responsibility of raising children, some couples discover they have grown apart or no longer share common goals and interests. In a gray divorce, sons and daughters have typically grown up and moved on, so there are no issues related to custody or child support. 

While divorce at any age can be complex, gray divorces often come with specific challenges, such as:

  • Division of retirement assets — Dividing martial assets in a fair and just manner is critical for divorcing spouses middle-aged and older, as there is less time to rebuild wealth prior to retirement. Understanding the tax implications of property division is also essential. Retirement assets such as pensions, IRA and/or Roth IRA accounts, and 401(k) accounts may need to be divided, which requires knowledgeable legal guidance. 
  • Healthcare needs — Older individuals should consider how divorce might affect their health insurance coverage and long-term care plans, especially if they have not worked for many years or are of retirement age. Losing access to a spouse’s employer-sponsored health insurance can be a significant concern.
  • Previous divorces — While some gray divorces dissolve decades-long unions, others come at the end of second or third marriages for one or both parties. If you’re going through a second divorce, or the end of a subsequent marriage, you might have to consider existing obligations when negotiating divorce terms.
